These Terms of Service (the “Terms”) form a legally binding agreement between you, the user and customer of our platform, and Studio Aroma S.A. de C.V. (“we”, “us”, “our”), the registered operator of the e-commerce website www.studioaromamex.com that sells premium sustainably sourced natural fragrance goods including reed diffusers, car diffusers, indoor aromatherapy products, and botanical scent accessories. By accessing, browsing, creating an account on, or completing any purchase on our Site, you confirm that you are at least 18 years of age (or the legal age of majority in your jurisdiction of residence), you have the full legal authority to enter into this binding agreement, and you have read, understood, and agreed to every provision laid out in these Terms. If you do not meet these eligibility requirements, or you do not agree to any part of this document, you are not authorized to access or use our Site for any purpose.

You are prohibited from attempting to bypass any security features on our Site, introducing malicious code, viruses, or harmful scripts to our servers, or interfering with the normal functioning of our e-commerce checkout and user experience features. Any unauthorized attempt to access restricted areas of our customer database, other users’ account information, or our internal administrative systems will be treated as a violation of Mexican federal cybersecurity laws, and we will report such activities to the relevant law enforcement authorities as required.
When you create a customer account on our Site to save your shipping details, track order history, access exclusive member-only offers, and save your favorite fragrance products to a wishlist, you agree to provide complete, accurate, and up-to-date personal information, including your full legal name, valid email address, and correct contact phone number. You are solely responsible for updating your account profile promptly if any of your personal information changes after registration.
You are fully responsible for maintaining the confidentiality of your account login credentials, including your account password, and all activities that take place under your registered account. We reserve the right to reject new account registration requests, or permanently disable existing accounts, for users who provide false personal information, have a history of violating our platform policies, or have previously engaged in fraudulent refund or return abuse on our site.
All products listed on our Site, including our full catalog of reed diffusers, car fragrance accessories, indoor deodorizers, and aromatherapy goods, are described and pictured to the most accurate standard we are able to produce. All product descriptions, ingredient lists, scent profile details, and product usage guidance are drafted to give customers as much transparent information as possible before they make a purchase. However, subtle natural variations in scent profile from batch to batch are normal for handcrafted products made with pure botanical ingredients, and these minor variations do not count as valid product defects under our policies. All product images displayed on our Site are for illustrative reference only, and slight differences in packaging color or material detail due to manufacturing runs do not qualify as grounds for a refund request.
All product prices displayed on our Site are listed in Euros by default, but we automatically support real-time currency conversion to Mexican Pesos, US Dollars, and 20 other major global currencies for customer convenience at checkout. All displayed product prices do not include applicable local sales tax, value-added tax, import duties, or shipping fees, all of which will be clearly calculated and displayed to you on the final checkout page before you confirm and submit your order. We take all reasonable steps to ensure that all pricing information on our Site is completely accurate, but occasional human or technical errors may result in incorrect pricing being displayed. In rare cases, a product may show as in stock at the time you place your order, but become fully out of stock before our fulfillment team processes your order due to simultaneous purchases by multiple customers. If this happens, our customer support team will contact you within 2 business days to notify you of the stock shortage, and offer you the options of selecting a comparable alternative fragrance product of equal value for free, waiting for the next restock of your selected item, or requesting a full refund for the out-of-stock portion of your order.
When you submit an order and complete the payment process on our Site, this constitutes an offer to purchase the selected products from us. Our formal acceptance of your order only takes place when we send you the official shipment confirmation email with your associated tracking number. In some scenarios, we may be required to decline or cancel your order even after your payment has been processed, including cases where the product you ordered is confirmed out of stock, your payment information cannot be verified, your order is flagged as potential fraudulent high-risk activity, or you have a prior history of violating our Terms of Service, Refund and Returns Policy, or Shipping Policy. If we cancel your order for any of these valid reasons after we have charged your payment method, we will issue a full 100% refund back to your original payment method promptly, with no hidden fees or deductions.

We never store full credit card numbers, CVV security codes, or complete sensitive financial data on our own internal servers, to fully protect your financial information security. You confirm that you are the legal authorized holder of the payment method you use to complete purchases on our Site, and you have full legal permission to use that payment method to make transactions. All payment transactions are subject to standard security verification checks to prevent credit card fraud, and we reserve the right to request additional identity verification documentation from you if we detect unusual transaction activity, before we proceed to process and ship your order.

To the full extent permitted by applicable Mexican and international law, Studio Aroma S.A. de C.V. shall not be held liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our Site, including but not limited to lost profits, lost savings, data loss, personal injury claims related to improper use of our fragrance products, or travel and accommodation costs incurred due to delayed shipping. Our total aggregate maximum financial liability for any and all claims related to your use of our Site or products you purchased from us is strictly limited to the total actual monetary amount you paid for the specific order that is the subject of your claim.
Nothing in this clause is intended to exclude or limit any legal liability that cannot be legally excluded under applicable mandatory consumer protection laws, including liability for personal injury caused by our proven negligence, or liability for fraudulent misrepresentation of our product safety information. We explicitly state that all our fragrance products are intended for normal household ambient use as described on product packaging, and you assume full responsibility for any damages or adverse health effects that arise from improper, non-recommended usage of our products that violates the printed product safety instructions.
We reserve the full unilateral right to modify, update, revise, or replace any part of these Terms of Service at any time at our sole discretion. When we make material changes to these Terms, we will update the effective date at the top of this document, post a prominent announcement on the homepage of www.studioaromamex.com, and send a notification email to all registered account holders with a clear summary of the key changes. Your continued access to and use of our Site after the revised Terms go into effect will constitute your full acceptance of the updated, modified terms. These Terms of Service shall be governed by, interpreted under, and enforced in full compliance with the laws of the United Mexican States, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or related to your use of our Site, your purchase of products from our platform, or the interpretation of these Terms shall first be resolved through good faith direct negotiation between you and our operations team, for a minimum period of 30 calendar days after one party notifies the other of the existence of the dispute.
If the dispute cannot be resolved amicably through direct negotiation, all formal legal proceedings will be exclusively conducted in the competent courts located in Mexico City, and you irrevocably consent to the personal jurisdiction of these Mexican courts for all legal proceedings related to any dispute with Studio Aroma S.A. de C.V. Nothing in this clause prevents you from filing a formal consumer protection complaint with the Mexican Federal Consumer Protection Agency (PROFECO) or the National Institute of Transparency, Access to Information and Personal Data Protection (INAI) for any issues related to consumer rights or personal data processing.
